Castle Design – Agent Agreement & Terms of Service

This agreement outlines the professional standards, operational protocols, and legal obligations between Castle Design (“The Company”) and the registered Representative/Agent (“The Agent”). By registering and operating within the SD Project Management platform, the Agent explicitly agrees to be bound by the following terms and conditions.

1. Agent Responsibilities & Code of Conduct

  • Brand Representation: The Agent shall at all times conduct themselves in a professional manner that upholds, protects, and promotes the reputation and integrity of the Company.
  • Truthful Representation: The Agent is strictly prohibited from making false claims or unrealistic promises to clients regarding project timelines, material costs, or the scope of architectural services.

2. Cash Handling & Payment Collection

  • Strict Prohibition: Agents are strictly prohibited from directly collecting or handling cash payments from clients in the field.
  • Authorized Payment Methods: All project-related payments must be made by the client exclusively via:
    1. Direct bank transfer to the Company’s official corporate bank accounts.
    2. Physical cash or card payments made in person at the Company’s Main Branch Office.

3. Commission Structure & Payout Protocols

  • Standard Commission Rate: The Agent is entitled to a standard commission of 10% based on the total agreed value of successfully onboarded projects. (Note: Preliminary charges, such as Site Visit fees, are strictly non-commissionable).
  • Payment Verification: Commissions are payable only after the client’s payment has been fully realized by the Company and the Administration has officially marked the invoice status as “PAID” within the system.
  • The Digital Handshake: Upon receiving the commission in their bank account, the Agent is legally obligated to log into the platform and click the “Confirm Receipt” button to digitally acknowledge the transaction.

4. Confidentiality & Data Protection

  • All client data, architectural blueprints, and financial quotations accessed through the system are the exclusive intellectual property of the Company. Disclosing this proprietary information to third parties or competing firms is strictly prohibited.

5. Termination & Account Suspension (Zero-Tolerance Policy) Any violation of the following will result in immediate termination of this agreement and potential legal action:

  • Brand Defamation: Engaging in any behavior (including social media posts) that damages the reputation of Castle Design.
  • Financial Fraud: Attempting to misappropriate funds or collecting unauthorized cash directly from clients.
  • Conflict of Interest: Using the Company’s network to promote or sell the services of external architects, contractors, or competing entities.

Castle Design – නියෝජිත ගිවිසුම සහ සේවා කොන්දේසි

මෙම ගිවිසුම Castle Design ආයතනය (“ආයතනය”) සහ පද්ධතියේ ලියාපදිංචි වන නියෝජිතයා (“නියෝජිතයා”) අතර ඇතිකරගන්නා වෘත්තීය එකඟතාවයකි. SD Project Management පද්ධතියේ ලියාපදිංචි වී කටයුතු කිරීම මගින්, නියෝජිතයා පහත සඳහන් නීති සහ කොන්දේසි වලට එකඟ වන බව පිළිගනී.

1. නියෝජිතයාගේ වගකීම් සහ ආචාර ධර්ම

  • සන්නාමය නියෝජනය කිරීම: නියෝජිතයා සෑම විටම පාරිභෝගිකයින් සමඟ කටයුතු කිරීමේදී ආයතනයේ ගෞරවය සහ කීර්ති නාමය ආරක්ෂා වන පරිදි වෘත්තීය මට්ටමෙන් කටයුතු කළ යුතුය.
  • සත්‍ය තොරතුරු ලබා දීම: ව්‍යාපෘති සඳහා ගතවන කාලය, වියදම් හෝ ආයතනයේ සේවාවන් පිළිබඳව පාරිභෝගිකයින් වෙත අසත්‍ය හෝ ඉටුකළ නොහැකි පොරොන්දු ලබා දීම සම්පූර්ණයෙන්ම තහනම් වේ.

2. මුදල් හැසිරවීම සහ ගෙවීම් එකතු කිරීම

  • සම්පූර්ණ තහනම: නියෝජිතයා විසින් පාරිභෝගිකයින්ගෙන් සෘජුවම අතින් මුදල් ලබා ගැනීම (Cash handling) සපුරා තහනම් වේ.
  • අනුමත ගෙවීම් ක්‍රම: සියලුම ව්‍යාපෘති ගෙවීම් පාරිභෝගිකයා විසින් සිදු කළ යුත්තේ පහත ක්‍රම දෙකෙන් එකකට පමණි:
    1. ආයතනයේ නිල සංස්ථාපිත බැංකු ගිණුම් වෙත සෘජුවම බැර කිරීම.
    2. ආයතනයේ ප්‍රධාන ශාඛාව වෙත පැමිණ සිදුකරන මුදල් හෝ කාඩ්පත් ගෙවීම්.

3. කොමිස් මුදල් ගෙවීමේ ක්‍රමවේදය

  • කොමිස් ප්‍රතිශතය: සාර්ථකව සම්බන්ධ කරනු ලබන ව්‍යාපෘති වල එකඟ වූ වටිනාකමෙන් 10% ක කොමිස් මුදලක් නියෝජිතයාට හිමි වේ. (සටහන: Site Visit වැනි මූලික ගාස්තු සඳහා කොමිස් මුදල් අදාළ නොවේ).
  • ගෙවීම් තහවුරු කිරීම: කොමිස් මුදල ගණනය කරනු ලබන්නේ පාරිභෝගිකයාගේ ගෙවීම් ආයතනයට ලැබී, පද්ධතියේ එම ගෙවීම “PAID” ලෙස තහවුරු කළ පසුව පමණි.
  • ඩිජිටල් තහවුරු කිරීම (Handshake): ආයතනය විසින් නියෝජිතයාගේ බැංකු ගිණුමට කොමිස් මුදල් බැර කළ පසු, නියෝජිතයා අනිවාර්යයෙන්ම පද්ධතියට ලොග් වී “Confirm Receipt” බොත්තම ක්ලික් කර එම ගනුදෙනුව තහවුරු කළ යුතුය.

4. රහස්‍යභාවය සහ දත්ත ආරක්ෂාව

  • පද්ධතිය හරහා ලැබෙන පාරිභෝගික තොරතුරු, සැලසුම් සහ මිල ගණන් ආයතනයේ සන්තකයක් වන අතර, ඒවා බාහිර පාර්ශවයකට හෝ තරඟකාරී ආයතන වෙත ලබා දීම සපුරා තහනම් වේ.

5. සේවයෙන් පහ කිරීම (Zero-Tolerance Policy) පහත සඳහන් කරුණු උල්ලංඝනය කිරීමකදී, කිසිදු පූර්ව දැනුම්දීමකින් තොරව ගිවිසුම අවලංගු කිරීමට සහ නීතිමය පියවර ගැනීමට ආයතනයට බලය ඇත:

  • සන්නාමයට හානි කිරීම: සමාජ මාධ්‍ය හරහා හෝ පෞද්ගලිකව Castle Design ආයතනයේ නාමයට කැළලක් වන ආකාරයෙන් හැසිරීම.
  • මුල්‍ය වංචා: ආයතනයේ මුදල් අවභාවිත කිරීමට උත්සාහ කිරීම හෝ පාරිභෝගිකයින්ගෙන් අනවසරයෙන් මුදල් ලබා ගැනීම.
  • වෙනත් ව්‍යාපාර ප්‍රවර්ධනය: ආයතනයේ පාරිභෝගිකයින් වෙත බාහිර ගෘහ නිර්මාණ ශිල්පීන්ගේ හෝ කොන්ත්‍රාත්කරුවන්ගේ සේවාවන් විකිණීමට උත්සාහ කිරීම.
